Welcome to Mockly. These Terms and Conditions ("Terms") govern your use of the Mockly mobile application and any related services (the "Service").

Acceptance of Terms

By creating an account, accessing, or using Mockly, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page and, where appropriate, notify you through the app or by other reasonable means. Your continued use of the Service after changes are posted means that you accept the updated Terms.

Eligibility

Mockly is intended for users aged 16 or over. By using the Service, you represent that you are at least 16 years old.

If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Accounts and Account Security

You may create an account using email, Google, or Apple sign-in. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate account information
  • Notifying us if you suspect unauthorised access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security, legal, or abuse risk.

Guest Mode

Mockly may allow limited use as a guest without creating an account. Guest mode has limitations:

  • Your data may not be saved between sessions
  • Access to certain features may be restricted
  • You may not have a persistent profile, history, or analytics

To save your progress and access full account features, you must create an account.

Acceptable Use

You agree to use Mockly only for lawful purposes. You must not:

  • Use the Service for any illegal, harmful, or unauthorised purpose
  • Upload content that is defamatory, obscene, abusive, hateful, harmful, or infringes another person's rights
  • Upload malware, malicious code, or content designed to interfere with the Service
  • Attempt to gain unauthorised access to the Service, user accounts, servers, or systems
  • Interfere with, disrupt, overload, or damage the Service or its infrastructure
  • Use automated scripts, bots, scrapers, or similar tools without permission
  • Impersonate another person, organisation, employer, recruiter, or candidate
  • Reverse engineer, decompile, disassemble, or attempt to extract source code from the app except where permitted by law
  • Use the Service to develop, train, or improve a competing product or service
  • Misuse AI-generated content or present it as professional advice or guaranteed career guidance

User Content

You may upload, record, submit, or create content through Mockly, including audio recordings, transcripts, CVs, interview answers, profile information, and feedback messages ("User Content"). You retain ownership of your User Content.

By submitting User Content, you:

  • Grant us a limited licence to host, process, analyse, display, and use it as needed to provide the Service
  • Confirm that you have the necessary rights and permissions to submit it
  • Confirm that your CV, interview answers, and other materials do not infringe third-party rights
  • Accept responsibility for the accuracy, legality, and appropriateness of the information you provide

We may use aggregated or de-identified usage information to improve Mockly, but we do not use your personal data to train our own AI models. Our use of personal data is described in our Privacy Policy.

License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable licence to use Mockly for your personal, non-commercial purposes in accordance with these Terms.

This licence does not include the right to sublicense, sell, rent, distribute, copy, modify, create derivative works from, or commercially exploit the Service.

AI-Generated Content Disclaimer

Important: Mockly uses artificial intelligence to provide interview feedback, analysis, summaries, suggested improvements, and coaching-style responses. AI-generated content is for informational and educational purposes only.

You acknowledge that:

  • AI responses may contain errors, inaccuracies, omissions, or biases
  • AI feedback does not constitute professional, legal, financial, medical, recruitment, or career advice
  • You should use your own judgment when applying AI suggestions
  • AI models and prompts may be updated, which may change the type or quality of feedback provided
  • You are responsible for checking and adapting any suggested answers before using them in real interviews or applications

No Employment or Career Outcome Guarantee

Important: Mockly provides interview practice and coaching tools. We do not guarantee job offers, interview success, employment outcomes, salary increases, admissions, promotions, or career advancement.

Interview success depends on many factors outside our control, including your experience, qualifications, communication, the employer's needs, market conditions, and decisions made by third parties.

Subscriptions and Billing

Mockly offers optional premium features through auto-renewable subscriptions. Subscription prices, durations, and included features are shown in the app before purchase.

  • Payment: Subscriptions are billed through the Apple App Store and managed using RevenueCat.
  • Renewal: Subscriptions automatically renew unless cancelled before the end of the current billing period.
  • Pricing: Prices are displayed in the app and may vary by country, currency, taxes, and App Store settings.
  • Premium Access: Premium features are unlocked based on your subscription entitlement status.
  • Price Changes: Subscription pricing may change in accordance with Apple's App Store rules and any required notice.

We do not collect or store your full payment card details. Payment processing is handled by Apple.

Cancellation and Refunds

You can cancel your subscription at any time through your Apple ID subscription settings. If you cancel, you will usually retain access to premium features until the end of your current billing period.

  • Deleting the Mockly app does not automatically cancel your subscription
  • Deleting your Mockly account does not automatically cancel your Apple App Store subscription
  • You are responsible for managing cancellation through your Apple ID settings
  • Refund requests are handled by Apple under Apple's App Store refund policies

Mockly does not directly process refunds for App Store purchases. Any refund request must be made through Apple.

Service Availability and Changes

We aim to keep Mockly available and working reliably, but we do not guarantee uninterrupted, error-free, or permanent access to the Service.

The Service may be unavailable or affected by:

  • Maintenance, updates, or feature changes
  • Technical issues, bugs, outages, or service interruptions
  • Third-party provider issues, including hosting, authentication, AI, payment, or App Store services
  • Network, device, operating system, or platform issues outside our control

We may modify, suspend, remove, or discontinue any feature or part of the Service at any time. Where appropriate, we will provide reasonable notice for material changes that significantly affect your use of the Service.

Suspension and Termination

We may suspend or terminate your access to Mockly if:

  • You violate these Terms
  • You misuse the Service or attempt to interfere with its systems
  • You submit harmful, illegal, abusive, or infringing content
  • We are required to do so by law or by a platform provider
  • Your account poses a security, fraud, abuse, or legal risk

You may delete your account from within the app by going to Profile > Account > Delete account. Upon account deletion or termination, your right to use the Service ends, and we may delete or retain data in accordance with our Privacy Policy.

Intellectual Property

The Service, including its design, branding, features, text, graphics, interface, software, prompts, workflows, and underlying technology, is owned by Mockly or its licensors and is protected by intellectual property laws.

"Mockly", our branding, and related visual elements may not be used without our written permission.

Nothing in these Terms transfers ownership of any intellectual property rights to you except the limited licence to use the Service described above.

Feedback

If you provide suggestions, ideas, reports, comments, or feedback about Mockly ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to use, modify, publish, and incorporate that Feedback into the Service without compensation or attribution to you.

Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will meet your specific requirements or expectations
  • The Service will be uninterrupted, timely, secure, accurate, or error-free
  • AI-generated feedback will be accurate, complete, suitable, unbiased, or reliable
  • Any defects, errors, or issues in the Service will be corrected
  • The Service will guarantee any job, interview, employment, or career outcome

Limitation of Liability

To the fullest extent permitted by law, Mockly shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, use, goodwill, opportunities, employment outcomes, or business interruption, arising out of or related to your use of or inability to use the Service.

To the fullest extent permitted by law, our total liability for all claims related to the Service shall not exceed the greater of £100 or the amount you paid to Mockly in the twelve (12) months before the claim.

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

Indemnity

You agree to indemnify and hold harmless Mockly from any claims, damages, losses, liabilities, costs, or expenses, including reasonable legal fees, arising out of or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • User Content you upload, record, submit, or create
  • Your reliance on AI-generated content in real interviews, applications, or career decisions

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection laws give you the right to bring proceedings in another jurisdiction.

Changes to These Terms

We may revise these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page.

If we make material changes, we may notify you through the app, by email, or by other reasonable means. Your continued use of Mockly after changes are posted means you accept the revised Terms. If you do not agree to the changes, you must stop using the Service.
